New Jersey Deputy Attorney General Arrested on AI-Generated CSAM Charges
Brian Richard Fitzgerald, 51, a New Jersey prosecutor, was arrested after investigators linked him to the creation and distribution of artificial intelligence-generated child sexual abuse material.

What happened
New Jersey's deputy attorney general Brian Richard Fitzgerald, 51, was arrested on felony charges related to AI-generated CSAM after the National Center for Missing and Exploited Children received a tip in July about a Discord user sharing illicit images. Investigators used digital forensics and subscriber records linked to the Discord account and associated IP addresses to trace the account to Fitzgerald's home. A search of his residence recovered prompts and scripts used to generate AI CSAM. Discord chat logs under the username "thegentlemanpervert_2160_07833" allegedly showed Fitzgerald admitting to creating multiple illicit images using artificial intelligence and sharing them with other users. According to authorities, Fitzgerald used AI to make photos from social media of real minors into sexualized images that he then distributed.
Context
The arrest reflects ongoing law enforcement efforts to prosecute AI-generated CSAM as a federal crime. Since 2024, when the DOJ made early arrests and clarified that AI-generated CSAM constitutes CSAM under US law, law enforcement has vowed to crack down on the practice. The case is significant because Fitzgerald held a position as a deputy attorney general—a prosecutor responsible for enforcing the law—while allegedly committing the crime himself. This demonstrates the issue extends beyond isolated individuals to those within the justice system.
